🛡️ OceanDrift Express – Terms & Conditions (Customer Agreement)
Effective Date: Monday, May 13, 2025

Please read this agreement carefully. By registering, you agree to the following terms. These protect both you and OceanDrift Express by ensuring transparency, efficiency, and legal compliance. These Terms are binding, enforceable, and serve as both shield and sword.


1. Who We Are (Business Overview & Legal Protection)

OceanDrift Express is a registered Jamaican courier and freight forwarding company based in Montego Bay. We provide last-mile delivery and international package forwarding from major online retailers such as Amazon, Temu, AliExpress, and TikTok Shop.

OceanDrift Express does not own or operate international shipping companies, warehouses, or airline cargo. We act as a freight forwarding and handling agent on behalf of our clients and are not responsible for any actions or policies of external vendors, customs authorities, airlines, or foreign warehouses.


2. How the Service Works

Upon registration, each customer receives a unique shipping ID (e.g., OCDX0001).

You will be assigned one of two U.S. addresses: AIR or SEA warehouse, located in Pompano Beach, Florida.

This code must appear in Line 2 of your shipping address when placing online orders.

🚨 OceanDrift Express is not liable for packages that are delayed, lost, or misrouted due to customers omitting or incorrectly entering their assigned code.

📦 Packages received with an invalid, incomplete, or incorrect address will incur a $7.45 USD invalid address fee per occurrence. This charge is non-refundable and must be paid prior to dispatch or delivery.


3. Pre-Alert Requirement

Before a package arrives at our U.S. warehouse, the customer must pre-alert the shipment via WhatsApp or online portal. This pre-alert must include:

  • Customer’s full name

  • Tracking number

  • Store name

  • Accurate item description

📌 Failure to pre-alert your shipment may result in delivery delays, misidentification, or extra handling fees.


4. Pricing & Payment (USD)

All prices at OceanDrift Express are listed and charged in United States Dollars (USD) as of June 30, 2025.

  • Rates begin at $5.50 USD/lb (AIR) and $13.50 USD/Cubic ft (SEA)

  • Charges are calculated based on the greater of actual or volumetric weight

  • Additional service charges (e.g., packing, rural drop-off, fragile handling) also apply in USD

💳 Accepted payment methods:

  • Cash on Delivery (COD)

  • Bank Transfer

  • Online Payment (Coming Soon)

💰 Non-payment at the time of delivery may result in withheld packages and suspension of your account.


5. Delivery Timeline

  • Shipments arrive in Montego Bay up to five (5) times per week.

  • Final local delivery is completed within 24–72 hours, depending on location and customs clearance.

🛑 OceanDrift Express is not liable for delays caused by:

  • Jamaica Customs

  • International shipping carriers

  • Vendor fulfillment delays

  • Weather or acts of God


6. Jamaica Customs – Invoice Requirement (MANDATORY)

In accordance with Jamaican law and international import regulations, Jamaica Customs requires that every imported package be accompanied by a legitimate, verifiable invoice to determine its declared value, item description, and intended use. This requirement is strictly enforced and non-negotiable.

✅ All customers of OceanDrift Express are required to:

  • Submit the original invoice from the vendor (e.g., Amazon, Temu, AliExpress, TikTok Shop, etc.)

  • Submit invoices prior to or upon notification that the item has reached our U.S. warehouse

  • Ensure the invoice includes:

    • Product name and description

    • Quantity and unit price

    • Order/purchase date

    • Seller and buyer information

    • Country of origin

📌 Packages will not be processed or released until a valid invoice is received and verified.
📌 Failure to provide a valid invoice may result in clearance delays, seizure, or customs non-compliance penalties.


7. Customs Liability Disclaimer & Legal Indemnification

OceanDrift Express acts solely as a logistics and delivery agent on behalf of its customers. We are not responsible, and will not be held liable, for any action taken by Jamaica Customs or foreign customs authorities, including but not limited to:

  • Import duties, taxes, surcharges, or brokerage fees

  • Seizure, delay, or destruction of packages by customs officers

  • Non-clearance or rejection of goods due to missing, incomplete, or incorrect documentation

  • Penalties, fines, or investigations triggered by under-declared or misrepresented invoice values

🚨 Providing false, forged, incomplete, or misleading invoice information is a criminal offense and will result in:

  • Immediate account suspension or permanent termination

  • Forfeiture of all unclaimed or flagged shipments

  • Referral to Jamaica Customs, Tax Administration Jamaica (TAJ), or law enforcement for prosecution

🛡️ By using our services, you agree to indemnify and hold harmless OceanDrift Express, its directors, agents, and affiliates from any and all liabilities, penalties, or claims resulting from customs violations, failure to comply, or falsified documentation.

✅ These clauses shield OceanDrift Express from fraud-related blame, customs penalties, operational risk, and brand damage.


8. Prohibited Items

Do NOT ship any of the following:

  • Weapons or ammunition

  • Illegal drugs or substances

  • Hazardous or explosive materials

  • Perishables or live animals

  • Counterfeit, stolen, or unauthorized items

❌ Violation will result in package seizure, account termination, and potential reporting to authorities.


9. Lost or Damaged Items

OceanDrift Express operates under a defined chain of custody and assumes liability only for goods within our verified possession.

🔒 OceanDrift Express is not responsible for:

  • Loss, damage, or delay before package reaches our U.S. warehouse

  • Vendor or seller errors

  • Carrier mishandling during U.S. domestic transit

  • Customer address errors or missing OCDX codes

📦 Responsibility begins only after:

  • Package is received and logged at our Jamaican facility

  • Pre-alerted customer ID is matched

  • Customs clearance is completed

📝 Claims must be submitted within 24 hours of delivery and must include:

  • Clear photo of damaged item and packaging

  • Original vendor invoice

  • Written statement

⛔ Claims submitted after 24 hours will be automatically denied.

✅ OceanDrift Express is not liable for indirect losses, including missed deadlines or business interruptions.


10. Storage Policy

All customers are required to accept or schedule delivery within seven (7) calendar days of receiving notification. After Day 7:

  • A $2 USD storage fee is applied every 2 days

  • After Day 21, the package may be:

    • Discarded

    • Returned to sender (at customer’s expense)

    • Resold to recover fees

📌 No additional notice is required before forfeiture or resale.
📌 Storage charges are non-refundable and may be deducted from future claims.


11. Refund Policy

OceanDrift Express maintains a No Refund Policy, with limited exceptions approved only by management.

Refunds may be considered only if:

  • A service was paid for but not rendered due to OceanDrift’s error

  • A billing miscalculation (not related to weight, customs, or policy enforcement) is proven

Refunds will NOT be issued for:

  • Customs delays or seizures

  • Vendor-related problems

  • Customer’s failure to submit invoices, use correct codes, or pre-alert packages

  • Unclaimed packages past storage limits

  • Payments outside approved channels

  • Breach of Terms or customs violations

📌 All refund requests must be made in writing within 3 business days of incident.


12. Customer Responsibilities

By registering with OceanDrift Express, you agree to:

  • Use your assigned shipping code correctly

  • Pre-alert shipments before arrival

  • Provide legitimate, unaltered invoices

  • Avoid prohibited or misrepresented items

  • Pay required fees on time

  • Treat OceanDrift staff respectfully


13. Privacy Policy

OceanDrift Express values and protects your personal data. We collect:

  • Full name, contact info, and address

  • TRN or ID (when required)

  • Shipment details and invoice records

We use this information to:

  • Process shipments

  • Satisfy customs compliance

  • Communicate delivery updates

  • Improve customer service

⚖️ Your data will never be sold or shared for marketing. Disclosure only occurs:

  • If required by law or court order

  • To Jamaica Customs or regulators

  • To authorized logistics partners

All data is securely stored and only accessible to OceanDrift staff.


14. Red Zone & Limited Access Delivery Policy

Delivery to communities marked as Red Zones (due to high-risk, poor access, or safety concerns) is subject to the following:

Examples of Red Zones include:

  • Flankers

  • Norwood

  • Salt Spring

  • Glendevon

  • Mount Salem

💰 Red Zone Surcharge: $2.50–$3.50 USD per delivery

🚫 No delivery into Red Zones after 4:00 PM. Delivery will occur only at secure public locations (e.g., gas stations or plazas). Missed meetings result in canceled delivery or account warning.

📦 Packages unclaimed due to failed Red Zone arrangements will follow our storage & forfeiture policy.


✅ Final Legal Acknowledgement

By using OceanDrift Express, you:

  • Acknowledge and accept these Terms

  • Agree to USD pricing and invoicing

  • Accept responsibility for customs compliance

  • Indemnify OceanDrift from third-party liability
